Section 85 - Children accommodate by health authorities and local education authorities

This section aims to ensure that local authorities are aware of, and take steps to secure the welfare of, children from their areas who, on a long-term basis, are being accommodated by NHS bodies or local education authorities.
The duty to notify
Under subsection (1), the duty to notify applies where the accommodating authority accommodates a child and either of the following conditions is met:
(a) the accommodating authority intend to accommodates the child for a consecutive period of three months; or
(b) the child has been accommodated for a consecutive period of three months (that is, where the authority started with the intention of accommodating for less than three months but the period of actual accommodation exceeds that).
Originally, the notification was simply to be given to the “responsible authority”.
