Section 51 - Refuges for children at risk

This section provides for refuges for children who appear to be at risk of harm. There are two possible types of refuge:

(a) a private or voluntary children’s home;

(b) a foster parent whom a local authority or voluntary organisation proposes should act as a refuge.

In both cases, the Secretary of State must issue a certificate in order for the home or foster parent to act as a refuge (in Wales, it is the Welsh ministers that issue any certificate).


The legal consequences of refuge status
While a certificate under this section is in force with respect to a refuge, various enactments concerned with the recovery of children who are away from home are suspended.
