Section 2 - Parental responsibility

This section deals with the acquisition upon a child’s birth, and the delegation of, parental responsibility (PR). The content of parental responsibility – the rights and responsibilities possessed by a person with PR for a child – are dealt with in section 3 of the Children Act 1989.
Mothers
A mother automatically has PR (sub-sections (1) and (2)).
Fathers and step-parents
A father has PR for a child if he is married to the child’s mother at the time of the child’s birth (sub-section (1)) or if he attains it in accordance with this Act.
