Introduction
On an appeal against the decision of the Youth Justice Board not to award long term contracts in respect of two secure children's homes, the Court of Appeal held that none of the grounds had been made out and that the Youth Justice Board had acted both reasonably and fairly.

Details of the case

Three claims before the court concerned the tendering process under which the principal defendant, the Youth Justice Board (YJB), awarded a total of ten contracts for the provision of accommodation for children and young people in secure children's homes (SCH's).

The linked proceedings were all concerned with the YJB's decision dated 26 March 2009, not to enter into long term contracts in respect of two particular SCH's in South London (SCH1) and Exeter, Devon (SCH2). The first claimant was a tenderer, a private contractor and the owner and operator of SCH1, in respect of which it tendered unsuccessfully for a contract. The second claimant was a young person who was at all material times detained in court ordered secure remand (COSR) at SCH1. The third claimant was a young person who was at all material times detained on COSR at SCH2.
