*Governing Body of X Endowed Primary School v Special Educational Needs and Disability Tribunal and others

JT was a pupil at a school under the jurisdiction of the appellant governors. JT suffered from Attention Deficit and Hyperactivity Disorder (ADHD), which was considered an “impairment” within the meaning of section 1 of the Disability Discrimination Act 1995. The manifestations associated with children with ADHD included temper tantrums and aggression. The school had encountered a number of difficulties with JT’s behaviour. There had been internal and external exclusions culminating in JT’s final exclusion from school. The behaviour leading to JT’s exclusion involved his physically abusing a teacher by scratching and kicking. The second respondents, JT’s parents, brought proceedings before the first respondent, the Special Educational Needs and Disability Tribunal (the tribunal).
